2. Acceptance of Terms of Use
By accessing, registering and/or using the LINKtoRide application ("Application"), any of its content, functionalities and services, you agree to these Terms of Use and our Privacy Policy incorporated herein. PrivacyPolicy
These Terms of Use apply to all users, registered or unregistered, of the Application (collectively "you", "user" or "users", as required by the context), regardless of the mode or means of use.
Content includes the user profile, text, software, scripts, graphics, sounds, interactive features, and other materials that you may view, upload, publish, transmit, send, make available, display, communicate, or post on the Application.
If you do not agree with any of these Terms of Use or our Privacy Policy, please do not access or use the Application.
By clicking "Connect with Facebook" or "Register with an email address" or "Connect with Apple", you agree that you have read and accepted all these general conditions of use of the application before creating an account.
3. Possibility to accept the Terms of Use
By accessing and/or using the Application, you affirm, declare, and warrant that:
You are fully able and competent to enter into the terms, conditions, obligations, statements, representations, and warranties set forth in these Terms of Use and to abide by and comply with these Terms of Use.
You are of legal age and possess a valid driving license if you use the application as a driver. When accessing, using, or registering in the Application, you declare and warrant that you are over 18 years old. Registration on the platform by a minor is strictly prohibited.
You understand that the application owner acts as an intermediary between the Application Users and the Beneficiaries of the funds obtained from free rides offered by drivers. You also understand that the Passenger’s contribution to the Beneficiary selected by the Driver will be distributed as a donation to the Beneficiary chosen by the Driver.
4. Changes to the Terms of Use
We reserve the right to modify these Terms of Use at any time, and you will be notified before they take effect. Your use of the Application following any modification of these Terms of Use signifies your consent and acceptance of the revised terms.
The updated version of the Terms of Use replaces any previous version immediately upon publication, and the previous version(s) will have no continuing legal effect. If you disagree with these changes, you are free to close your account at any time.
5. Definitions
In the content of these terms of use, the following terms have the meanings set forth below:
“Application” has the meaning set forth in Article 6 below;
"T&C" means these Terms and Conditions;
"User Account" means the account that must be created to become a Member/User in the application and to access or offer rides through the Application;
"Member/User" means any person who has created an Account in the Application, who can be both a Driver and a Passenger;
"Driver" is the User who uses the Application and offers seats available in their vehicle to other persons on their route, in exchange for an amount of money that will be converted into a donation to a Beneficiary chosen by them;
"Passenger" refers to the Member who has accepted the offer to be transported by the Driver and donates to the Beneficiary chosen by the Driver;
The Beneficiary represents the nonprofit organization, association, foundation, school, kindergarten, or any other institution, etc., which is listed in the Application in the NGO section and will benefit from donations made by Passengers through the application;
"Ride" represents the journey that is the object of the Announcement published by a Driver on the Application, for which they agree to transport Passengers in exchange for making a donation to the Beneficiary chosen by the Driver;
"Contribution to the Beneficiary" means, for each Trip, the amount of money paid by the Passenger as a sponsorship/donation to the Beneficiary chosen by the Driver, consisting of the equivalent of the fixed fare, multiplied by the number of kilometers and the number of people;
"Seat" represents the seat made available by the Driver and which may be reserved by a Passenger in the Driver's vehicle;
“Ride Booking” has the meaning set forth in Article 7.5 below.
6. About the application
Mazilu & Partners has developed a platform for the shared use of vehicles in the form of a mobile application and with the aim of putting drivers going to a certain destination in contact with passengers going to the same destination, in order to generate sponsorships to the Beneficiaries. (hereinafter referred to as the "Application").
These terms and conditions are intended to govern access to and conditions for the use of the Platform. By enrolling in the application, you understand and agree that LinktoRide is not part of any agreement, contract, or contractual relations of any kind between Members of its Platform (Drivers and Passengers).
7. Use of the Application
7.1. Creating an account
To register in the Application, you must first read and accept these T&C. The Application only allows its Members to post and view Announcements and interact with each other to reserve a seat in a car. You can view ride announcements in the application only if you are registered in the application, and to post an Announcement and/or be able to reserve a seat in the Driver’s car, you need to create an Account and become a Member.
To create an Account, you have the following options:
(i) either complete all required fields in the registration form in the application;
(ii) either connect to your Facebook account through the Application (hereinafter referred to as "Facebook Account");
(iii) either sign in from your Apple account.
By creating an account, you understand that the application will have access to, publish in its content, and store certain information about you from the accounts used for registration. If you wish to learn more about the use of your data, please read our Privacy Policy.
When creating an Account, regardless of the method chosen, you agree to provide accurate and truthful information and update it through your profile to guarantee its relevance and accuracy in all dealings with the Application.
In the case of registration by email, you agree to keep the password chosen when creating your Account secret and not to disclose it to anyone. If you lose or disclose your password, you undertake to immediately inform LinktoRide. You are solely responsible for the use of your Account by third parties unless you have expressly notified LinktoRide of the loss, fraudulent use by a third party, or disclosure of your password to a third party.
You also agree not to create or use, under your identity or that of another person, any other accounts than the initially created one.
7.2. Registration in the Application
For enrollment in the application, each member must be at least 18 years old at the date of registration.
7.2.1. Necessary conditions for registration as a Driver:
a) You are authorized to initiate a Race only if you meet all of the following conditions:
You hold a valid driver's license;
You meet all the legal requirements for driving a vehicle during the Ride;
You make Listings for vehicles you own or use with the explicit consent of the owner and, in all cases, you are authorized to use them for ridesharing purposes;
You are and remain the primary driver of the vehicle subject to the Listing;
The vehicle has valid insurance against third-party damage;
You have no medical contraindications or incapacity to drive;
The vehicle you intend to use for the Ride is a four-wheel car with a maximum of 7 seats, excluding vehicles that do not require a driving license to operate;
You do not offer more Seats than the number available in your vehicle;
All offered Seats have a seatbelt, even if the vehicle is approved with seats that do not have seatbelts;
You use a vehicle in good working condition that complies with current legal provisions, meets standard practices, and has an up-to-date technical inspection certificate (ITP);
You are a consumer and not acting as a professional.
You agree that you are solely responsible for the content of the Announcement you post in the Application.
You declare and guarantee the accuracy and truthfulness of all information in your Announcement and commit to performing the Ride under the conditions described in your Announcement.
You have selected a Beneficiary from the Application to whom the ride cost should be directed as a sponsorship;
You agree that your announcement will be posted in the Application and visible to Members conducting a search in the Application.
You accept that LinktoRide reserves the right, at its discretion, not to post or to remove, at any time, any Announcement that does not comply with the T&C or that is considered to prejudice its image, the Application, or the Services and/or to suspend the Member's Account that posts such Announcements per Section 7 of these T&C.
You agree and accept the criteria considered in ranking and displaying your Announcement order among other Announcements according to LinktoRide’s exclusive choice.
You agree not to be financially remunerated for any ride and accept that all money paid by your Passengers goes to the Beneficiary chosen by you before posting each announcement.
Ensure that you can be contacted by your Passengers by phone at the number registered on your profile, including at the meeting point.
7.2.2. Necessary conditions for registering in the application as a Passenger
To qualify as a passenger, before booking a ride, you commit to making a donation, then pay for the rides at the end of each calendar month, with the payment being directed as sponsorship to the Beneficiary chosen by each individual Driver.
When using the application as a Passenger, you undertake the following:
To adopt appropriate conduct during the Ride so as not to disturb the Driver’s concentration or driving or the peace and quiet of other Passengers;
To respect the Driver’s vehicle and its cleanliness;
In the event of a delay, to promptly inform the Driver;
To make the monthly sponsorship for the rides you have benefited from, at the end of each calendar month, via a bank card, with the sums of money having the status of donations to Beneficiaries;
To wait for the Driver at the meeting place at least 5 minutes before the set time;
Not to have during the Ride articles, goods, substances, or animals that could disturb the driving and concentration of the Driver or the nature, possession, or transport of which contravenes the legal provisions in force;
To ensure that the Driver can contact you by phone at the number registered on your profile, including at the meeting place;
That you are solely responsible for the selection of the ride according to the Announcement posted in the Application.
Declare and guarantee the accuracy and truthfulness of all information in your account and undertake to complete the route under the conditions described in the Announcement selected by you among those posted in the App by the Driver, without deviation from the preset route.

7.2.3. Obligations of all users of the Application
All application users understand that access and registration to it, as well as searching, viewing, and publishing Announcements, are free. Instead, the value of each trip is converted into a donation, in the conditions described below.
As a Member and provided you meet the conditions above, you may create and post Announcements in the app, entering information about the Ride you intend to take or schedule if you are a driver or the ride you wish to reserve as a Passenger (date/time and meeting and arrival points, number of seats offered, available options, the value of the Contribution to Beneficiaries – the equivalent of the fixed tariff multiplied by the number of kilometers, and the number of people, etc.).
When posting the Ad, as a Driver, you can indicate the main locations where you agree to stop, where to pick up or drop off Passengers, anywhere on the map.
The portions of the Race between these locations or between the meeting or finish point of the Race are “Segments”.
Each user agrees and accepts that they are solely responsible for complying with all laws, regulations, and obligations applicable when using the Application; the Platform Owner has no liability in any situation of any nature in which Application Members may be involved, such as but not limited to: a traffic incident, inappropriate behavior by any Users, altercations, or conflicts between Users, licentious language, etc.
Additionally, when using the Platform and during Rides, you commit to:
Respect these T&C and any other applicable platform terms and conditions that apply to you;
Not to use the Application for professional, commercial purposes, or profit-making;
Not to send to LinktoRide (especially when creating or updating your Account) or any other User false, misleading, malicious, or fraudulent information;
Not to speak or behave in any way, or post any content (including Messages) in the Application that is defamatory, harmful, obscene, pornographic, vulgar, offensive, aggressive, improper, violent, threatening, harassing, racist or xenophobic, or with sexual connotations that incite violence, discrimination or hatred, to encourage activities with or the use of illegal substances or, more generally, illegal, contrary to the applicable law, these T&C, and the purposes of the Application which may infringe LinktoRide's rights or those of a third party or be contrary to good morals;
Not to infringe the rights and image of LinktoRide, especially its intellectual property rights;
Not to open more than one Account in the application, and not to open an Account on behalf of a third party;
Not to take actions to bypass the app's online booking system, especially by trying to convey a Driver's contact details to make a reservation outside the Application to avoid paying the donation for the Ride;
Not to accept or make payments in connection with the Application, other than donations or sponsorships to the Beneficiary chosen by the Driver.
7.3. Personal data
In the context of registering in the Application, you accept and understand that LinktoRide will collect and process some of your personal data, as specified in the Privacy Policy.

7.3.1.5 For Wallet
– To pay for rides, the user must enter their card details when adding credit. The card details will not be stored in the application. Each time they top up with credit, they will need to fill in their card details, just like when paying for online purchases.
7.3.1.6 For the Account we require
– Profile picture – to set or change your profile picture, we will request permission to access your camera or gallery.
The way of collecting data is directly from the user, from the traffic reports recorded by the servers that host the site, from where we can find out certain information about you, such as your address. IP, the time of your visit, the place from which you entered our website, as well as from the Linktoride app, only if you open an account.
7.3.2. How we use personal data

To provide you with access to the functionalities of the linktoride.com website and the linktoride application;
For the administration of the linktoride.ro website;
For the analysis and improvement of the linktoride.ro website and the application that we own;
To send you non-commercial or administrative messages (regarding the user account, changes in the site, changes in services, etc.);
7.3.3. The processing grounds on which these purposes are based
For all purposes, the basis for data processing lies in our legitimate interest to ensure the proper functioning of the website and the application as well as the improvement of the website.
7.3.4. Security of personal data
The confidentiality and protection of the information collected from you are a priority for us.
Mazilu & Partners does not provide the collected information to third parties without your express and prior consent. Any statistics on our users' traffic, which we will provide to third- party advertising networks or partner sites, is provided only as an aggregate and does not include any personally identifiable information about any individual user.
Your access to the linktoride application is protected by a password. We recommend that you do not disclose this password to anyone. The application will never ask you for your account password in unsolicited messages or phone calls. We advise you not to disclose this password to people who ask you for it.
7.3.5. The right to erasure of data and other rights you have
According to the provisions of Regulation (EU) 679/2016 on the protection of personal data, you have the following rights with regard to the processing of personal data:

7.4 Posting an Announcement
Before starting a ride, the driver publishes their route (schedule ride), indicating departure time, departure, and arrival points, and Google maps will automatically calculate the number of kilometers. The donation value is equal to the number of kilometers multiplied by the number of passengers. The ride announcement will implicitly contain the ride value applicable to one passenger.
Each Driver can predefine a route they frequently travel, with the possibility for Drivers to permanently book rides to the same destinations – home/work, for example.
Each Driver has the freedom to accept or refuse the rides for which they receive booking requests, as they offer their car for free.
7.5 Booking a Ride
A Passenger Member wishing to take a ride can search for the rides available by Drivers on the route they intend to travel. Depending on the ride announcements available, they can reserve one or more seats in the car they want to travel in.
The ride value per kilometer is the same for all users, and the entire value will convert into a donation to the Beneficiary selected by the Driver. Passengers have the possibility to permanently book rides to the same destinations – home/work, for example.
7.6 Making a Donation
Each ride offered free of charge by the Driver converts into a sponsorship to the Beneficiary chosen by the Driver, with the donation value being determined based on the number of kilometers traveled and the number of passengers.
The entire amount paid by the Passenger as a donation will be sent to the Beneficiary chosen by the Driver, for each trip the Beneficiary being the sole recipient of the sponsorships.
7.7. Mileage accumulation – the significance of the 1000 km difference between the PassengerDriver roles
Through offering rides as a Driver or booking rides as a Passenger, kilometers offered (Driver) / used (Passenger) accumulate in their account.
As a Passenger, the user can benefit from the minimum donation values if the number of kilometers used (as a Passenger) minus the number of kilometers offered (as a Driver) does not exceed 1,000 KM.
If this kilometre balance exceeds the 1,000 KM threshold, the donation value required to be paid by the Passenger will double.
If the kilometer balance returns below the value of 1,000 KM, the Passenger will be able to benefit again from the minimum donation values.
The lowest donation per kilometer is when the application is used in both roles, both as a Driver and Passenger, to stimulate the circular economy. The application’s objective is to stimulate circular economy activities, improve environmental impact, reduce transportation costs, and support humanitarian causes.
8. Account suspension
Any member's account may be suspended in the following cases:
A complaint has been filed against them by another user at the email address dedicated for this purpose;
If they violate these terms and conditions;
If they do not pay the donation value accumulated in their account after each month, as found in their electronic wallet in the Application.
9. Account deletion
Each user is free to request the deletion of their account at any time, the application will remove all their data, except in the case where their account has been suspended by blocking it by the application owner for any of the reasons mentioned in art. 8, when their account opening data is kept in order to prevent people who have already had inappropriate behavior or have accumulated unpaid outstanding debt for making donations from using the application.
10. Liability
Application users understand that the application owner has no liability regarding any incident that may occur during the use of the application/rides carried out, each user assuming their own responsibility for all activities conducted through the application.
Thus, each Member fully assumes responsibility for anything that can happen on the route where Users travel together, such as any similar situations, but not limited to – loss of personal items, inappropriate behavior by another person traveling in the same car, driving under the influence of prohibited substances, spontaneous conflicts, irresponsible driving, accidents, etc.
11. Non-commercial purpose of the Services obtained through the application
The owner of this application does not charge any fee from its users (Drivers and Passengers) as it has developed this application to benefit both users and the Beneficiaries' causes in Romania supported by users, as well as the environment.
In order to be listed in the application and for the administrative operations of collecting donations, the Beneficiaries will pay the Application Owner a fee that will be established by separate agreement between the Application Owner and the Beneficiaries in the application by applying a percentage applied to the Beneficiary's monthly receipts through the application, this being the lower, the larger the donation, as follows:

12. User Verification
For transparency purposes, trust improvement, and fraud prevention or identification, LinktoRide may install a system to verify some of the information you have provided in your profile. This is particularly applicable when you enter your phone number, provide an identity document, or indicate your place of work.
By opening an account in the application, you agree and accept that any reference on the Platform or Services to "verified" information (including "Verified Profile"), or similar term, only means that a Member has passed the existing verification procedure on the Platform or Services to provide you with more information about the Member you consider traveling with.
LinktoRide cannot guarantee the truthfulness, fidelity, or validity of the information subject to the verification procedure, with each user fully assuming responsibility for the information provided.
13. Applicable law and disputes
These Terms and Conditions of Use are in the Romanian language and are subject to the law of Romania.
You can contest the decisions we may make regarding your account, and you can submit your complaints online to the European Commission, accessible here. aici
The European Commission will forward your complaint to the competent national court.
In compliance with applicable mediation rules, you are required, before any mediation request, to notify LinktoRide in writing regarding any app malfunctions, to obtain an amicable solution.
You should also be aware that the app owner does not offer any services, sell any products, or collect any fees from App Users, having no obligation to App users, other than respecting personal data.
We are not responsible for delays or deficiencies in the operation of the application, which result from causes beyond our reasonable control, and, to the extent that you no longer wish to use the application, you are free to request the deletion of your account without any charge.
